AGREEMENT TO TERMS

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “user”) and TEKSERV & SOLUTIONS INC. (“TEKSERV,” “Company,” “we,” “us,” or “our”) governing your access to and use of TEKSERV websites, mobile applications, games, software, products, social features, technologies, and related services (collectively, the “Services”).

TEKSERV develops digital platforms, games, communication tools, and community technologies designed to connect people, promote healthy engagement, encourage strategic interaction, and support online communities.

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of the Services.

We may modify these Terms from time to time. If we make material changes, we will provide notice through the Services, by email, or by other reasonable means. Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the updated Terms.

ELIGIBILITY AND AGE REQUIREMENTS

The Services are intended for users who are at least 13 years of age.

If you are under the age of majority in your jurisdiction, you may only use the Services with permission and supervision from a parent or legal guardian.

U.S. Children’s Privacy

We do not knowingly collect personal information from children under 13 years old without verifiable parental consent in compliance with the Children’s Online Privacy Protection Act (“COPPA”). If we learn that personal information from a child under 13 has been collected without proper authorization, we will promptly delete the information.

EEA / UK Children’s Privacy

If you are located in the European Economic Area (“EEA”) or the United Kingdom (“UK”), parental consent may be required for users below the digital age of consent applicable in your jurisdiction.

SERVICES

The Services may include:

• Mobile games and multiplayer experiences
• Social networking and communication features
• Community groups and messaging
• Virtual currencies and digital items
• Leaderboards, rankings, achievements, and progression systems
• User-generated content
• Payment and subscription features
• Web applications and APIs
• Future services, software, or products developed by TEKSERV

Some Services may be subject to additional guidelines, policies, or rules.

ACCOUNT REGISTRATION

You may be required to create an account to access certain Services.

You agree that:

1. All information you provide is accurate and current.
2. You will maintain the security of your account credentials.
3. You are responsible for activities occurring under your account.
4. You will immediately notify us of unauthorized access or security breaches.
5. You will not create accounts using false identities or automated methods.

We reserve the right to suspend or terminate accounts that violate these Terms.

PRIVACY, DATA PROTECTION, AND INTERNATIONAL TRANSFERS

By using the Services, you acknowledge and agree that your information may be transferred to and processed in the United States and other countries where we or our service providers operate.

If you are located in the EEA, Switzerland, or the UK, we process personal data in accordance with the General Data Protection Regulation (“GDPR”) and UK GDPR.

USER CONTENT AND CONTRIBUTIONS

The Services may allow users to create, upload, post, share, transmit, or distribute content (“Contributions”), including text, messages, usernames, images, audio, video, gameplay content, and other materials.

You retain ownership of your Contributions.

However, by submitting Contributions, you grant TEKSERV a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, adapt, publish, distribute, publicly display, and use your Contributions in connection with operating, improving, marketing, and providing the Services.

You represent and warrant that:

1. You own or have rights necessary to submit the Contributions.
2. Your Contributions do not infringe intellectual property or privacy rights.
3. Your Contributions comply with applicable laws.
4. Your Contributions do not contain illegal, abusive, harassing, hateful, defamatory, or sexually exploitative material.
5. Your Contributions do not exploit or endanger minors.

We reserve the right to remove or restrict any Contributions at our sole discretion.

COMMUNITY GUIDELINES AND PROHIBITED CONDUCT

You agree not to:

• Violate laws or regulations
• Harass, threaten, or abuse others
• Engage in hate speech or discrimination
• Impersonate individuals or entities
• Exploit bugs or cheats in games
• Use bots, automation, or unauthorized scripts
• Reverse engineer the Services
• Circumvent security systems
• Distribute malware or harmful code
• Spam or manipulate engagement systems
• Buy, sell, or transfer accounts without authorization
• Collect personal data of other users without consent
• Use the Services for fraudulent or deceptive activities
• Promote illegal gambling, terrorism, or violent extremism

We may investigate violations and cooperate with law enforcement where appropriate.

MODERATION, REPORTING, AND ENFORCEMENT

We reserve the right, but not the obligation, to monitor content, investigate reports, moderate user behavior, and remove content that violates these Terms or applicable laws.

Users may report content or conduct through in-app reporting systems or by contacting support@tekserv.nyc.

Where feasible, users may appeal moderation decisions.

We may suspend or terminate accounts that repeatedly violate these Terms.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Services and all related software, code, designs, graphics, trademarks, databases, interfaces, text, audiovisual content, and other materials are owned by TEKSERV or licensed to us and are protected by intellectual property laws.

You are granted a limited, revocable, non-transferable, non-exclusive license to access and use the Services for personal, non-commercial purposes.

You may not:

• Copy or reproduce the Services
• Modify or create derivative works
• Use our trademarks without permission
• Redistribute proprietary content
• Reverse engineer or decompile the Services except where prohibited by law

All rights not expressly granted are reserved.

MOBILE APPLICATION LICENSE

Use License

If you access the Services via a mobile application, we grant you a revocable, non-exclusive, non-transferable, limited license to install and use the application on devices owned or controlled by you strictly in accordance with these Terms.

You shall not:

1. Reverse engineer or decompile the application;
2. Modify or create derivative works;
3. Use the application unlawfully;
4. Remove proprietary notices;
5. Use the application for unauthorized commercial purposes;
6. Use the application to develop competing products;
7. Use unauthorized automation or scraping tools.

Apple and Android Devices

The following terms apply when you use a mobile application obtained from either the Apple App Store or Google Play Store (“App Distributor”):

1. The license granted is limited to use on devices utilizing Apple iOS or Android operating systems.
2. App Distributors are not responsible for maintenance or support.
3. App Distributors may provide refunds in accordance with their policies.
4. You represent that you are not located in countries subject to U.S. embargoes or sanctions.
5. You must comply with third-party agreements applicable to your device or wireless provider.
6. App Distributors are third-party beneficiaries of these Terms.

Platform Rules & Tracking

Where required by applicable law or platform rules, we will obtain consent before using tracking technologies or advertising identifiers such as Apple IDFA or Android GAID.

In-App Billing

Digital purchases made through the Services may be processed through Apple In-App Purchase, Google Play Billing, or other authorized payment providers.

Refunds are subject to applicable platform rules and local law.

VIRTUAL CURRENCY AND DIGITAL ITEMS

The Services may include virtual currencies, points, coins, achievements, skins, cosmetic items, rewards, or digital assets (“Virtual Items”).

Virtual Items:

• Have no monetary value;
• Are licensed, not sold;
• Are non-transferable unless explicitly permitted;
• May not be redeemed for cash;
• May be modified, revoked, or discontinued at any time.

You acknowledge that Virtual Items are part of a limited license.

We reserve the right to manage, regulate, modify, or eliminate Virtual Items without liability.

IN-APP PURCHASES AND SUBSCRIPTIONS

Certain Services may require payment.

You agree to pay all applicable fees and taxes.

Subscriptions may automatically renew unless canceled before renewal.

You authorize us and our payment processors to charge your payment method.

Failure to pay fees may result in suspension or termination.
